low battery warning with near fully charged battery

I just installed Fedora core 4 on my wife's Toshiba m40x-rs1 with a few tweaks it works great. The only problem I'm having is a window keeps popping up warning me that the battery is low which it is not. If I look at the battery applet on the taskbar it shows it as 0% even though a few seconds before it showed with a nearly full charge which it has and if I check a few second later it will show the charge level accurately again. this only happens when running on battery power not plugged in. ACPI seems to be running okay as I can hear the fan cycling on and off. when I checked the /var/log/acpid file I see this event happened repeatedly:

[Mon Aug 15 15:24:21 2005] notifying client 2478[0:0]
[Mon Aug 15 15:24:21 2005] notifying client 2977[500:500]
[Mon Aug 15 15:24:21 2005] completed event "battery BAT1 00000081 00000001"
This is my first laptop install so any help would be appreciated thanks in advance.
