Using MP3 codecs are not illegal for home users at least that's what the
FAQ said:

If you think that's not right, then please send a mail to Max who edits the
FAQ
I use ogg when possible but I want MP3 ability if a web page has a mp3 file on
it since I can't control what they use. Suppose it's a recording of a lecture, speech,
press release or something. I'm not talking about ripping off and listening to mp3 music.
