It starts fine, havent bothered trying to play offline, but online its playing very choppy. I have the latest nvidia driver installed, patched 3369. On the same machine it runs fine on windows. any ideas on how to get it running right?

Hardware specs? Plus there's an additional patch which is marked as 33.69.1, you have that?

hardware wise I have a 1.6ghz, nvidia fx5200 --driver nvidia 100.14.03 (for some reason livna cant keep up with the kernel updates kernel-2.6.21-1.3189.fc7 hehe), 1gm ram, Thet do you have a link to it?

Thet still choppy almost barely playable, whats funny is that ut goty runs fantastic

Well, with your specs you can't expect it to run über-fast, either... Maybe you need to tweak the graphics a bit? First off, make sure you are not using any special postprocessing effects (AA/AF/Texture sharpening, etc). Then make sure you are running at a reasonable resolution with reasonable (for your hardware) visual settings (texture quality, mesh complexity, etc) That should help (unless you already are running in the low-med region)

I guess there is one thing that windows was good for arghhhh but I lowered everything and its at least playable now. its deffinately not worth putting xp back on this machine haha. I just dont get the disparity, everything is running faster under linux with the exception of UT2004

I'm sure there are some more tweaks you could use. I've not seen many "highend" games played on D3D on my GF's 5200, I haven't seen any, actually... So I'm not sure what might the DirectX and OpenGL renderes may be doing differently from Windows to Linux (the Windows OpenGL renderer of the latest patch is virtually the same as the Linux one, being both based on the same codebase). Maybe this has to do with render paths in OpenGL and DirectX differences that gives DirectX an edge in performance in Windows copared to OpenGL, but then again, you would have to run some benchmarks with both on Windows (and like you said, not worth the time).
Just to make sure... You're not running UT2K4 with Beryl or Compiz running, do you?

hahaa running it with Beryl or Compiz, I tried it once by accident. Well I changed over to the livna nvidia drivers and its running a bit better. Installing windows is not really an option I cant imagine wasting HD space on that. On a posative note Ill install it on my girls computer and drive her nuts. But just for a laugh, as soon as I get it running how I like my monitor blew tonight, so for the first time my piece of crap computer is off until tommorow
